Terms of Service

These Terms of Service ("Terms") govern your use of the Bloom Giving website at bloomgiving.org ("Site") and the Bloom platform services. This Site and the Bloom platform are operated by Bloom One LLC ("Bloom," "we," "us," or "our"), a Delaware limited liability company. Bloom provides website hosting, donation processing, SEO optimization, email automation, Google Ad Grants management, and donor management tools for animal shelters and nonprofit organizations.

By accessing this Site or using our services, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

1. About Bloom

Bloom One LLC is a for-profit technology company that provides a managed growth platform for 501(c)(3) animal shelters and nonprofit organizations. Bloom is not a nonprofit organization. Our services include building and hosting websites, processing donations, managing SEO, running Google Ad Grants campaigns, automating email communications, and providing donor management tools on behalf of our client organizations.

2. Platform Services

For Organizations

Organizations that sign up for Bloom receive a managed suite of services as described on this Site. Specific terms of the service relationship between Bloom and each organization are governed by the applicable service agreement.

For Donors

When you make a donation through a Bloom-powered website, you are donating to the nonprofit organization that operates that website — not to Bloom. Bloom facilitates the transaction as a technology and payment processing provider.

3. Donation Processing

Payment Processing

All donations made through Bloom-powered websites are processed using Braintree (a PayPal service) as the payment processor. Bloom collects the funds and disburses them to the applicable organization.

Processing Fees

Donation processing incurs a fee of 2.9% + $0.30 per transaction. Donors may be given the option to cover this fee so the organization receives 100% of the intended donation. If the donor does not cover the fee, it is deducted from the organization's share.

Platform Tips

Donors may be given the option to add a voluntary tip to Bloom to support the platform. Platform tips are:

  • Separate from the donation to the organization.
  • Retained by Bloom One LLC as revenue.
  • Not tax-deductible as a charitable contribution.

This is how Bloom sustains itself. We do not charge organizations platform fees or monthly subscriptions.

Finality of Donations

All donations are final. Refunds are generally not available except as required by law, at our discretion, or in cases of verified fraud. If you believe a donation was made in error, contact the organization directly or email us at hello@bloomgiving.org within 60 days of the transaction.

Tax Deductibility

Donations made to 501(c)(3) organizations through Bloom may be tax-deductible to the extent permitted by law. Tax receipts are issued by the receiving organization. Optional platform tips paid to Bloom One LLC are not charitable contributions and are not tax-deductible. Please consult your tax advisor.

4. Payment Methods

Bloom-powered websites accept: Credit/Debit Cards (Visa, Mastercard, Amex, Discover), PayPal, Venmo, ACH Bank Transfer, Apple Pay, and Google Pay (availability may vary). All payment methods are processed securely. Sensitive payment information is never stored on Bloom's servers.

5. Marketing Site

This Site (bloomgiving.org) is Bloom's marketing and informational website. Information submitted through contact forms, demo requests, or other forms on this Site is used to respond to your inquiry and, with your consent, send you communications about Bloom's services.

6. User Conduct

You agree not to:

  • Make fraudulent donations or use stolen payment methods.
  • Attempt to circumvent security measures.
  • Use automated tools to scrape or interact with the Site.
  • Interfere with the Site's operation.
  • Impersonate another person or organization.
  • Use the Site for any unlawful purpose.

We reserve the right to refuse or reverse any transaction reasonably believed to be fraudulent or unauthorized.

7. Intellectual Property

The content on this Site (text, images, design, logos) and the Bloom platform (software, technology, user interface) are the property of Bloom One LLC. You may not reproduce, distribute, or create derivative works from this content without our written permission.

8. Disclaimer of Warranties

THIS SITE AND THE BLOOM PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. BLOOM DOES NOT WARRANT THAT THE SITE OR PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOOM ONE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS SITE OR THE BLOOM PLATFORM. BLOOM'S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES YOU HAVE PAID TO BLOOM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Bloom One LLC and its officers, directors, employees, and agents from any claims arising from your use of this Site, your violation of these Terms, or any fraudulent transaction you initiate.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware. If you have a dispute, please contact us at hello@bloomgiving.org first. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Delaware.

12. Changes to These Terms

We may modify these Terms at any time. Material changes will be posted on this Site with an updated "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the modified Terms.
